Terms of Service
1. Who we are
SnowBrains Weather is operated by SnowBrains LLC, the forecasting arm of SnowBrains, a skier-run mountain community. You can reach us at contact@snowbrains.com.
2. Eligibility and your account
You must be at least 13 years old to use the Service, and old enough to form a binding contract to purchase SnowBrains Premium. Some features require an account, which you create using your email address. You are responsible for the activity under your account and for keeping access to your email secure. Please provide accurate information and let us know promptly of any unauthorized use.
3. Forecasts are information, not guarantees
SnowBrains Weather presents official forecasts and data from third-party sources, including the U.S. National Weather Service, Environment Canada, and NRCS SNOTEL, along with our own summaries and community reports. Weather forecasts are inherently uncertain. The Service is provided for general informational purposes only and is not a substitute for official warnings or professional judgment.
Do not rely on the Service for decisions where safety depends on accuracy, including backcountry travel, avalanche assessment, or any life-safety decision. Always consult official avalanche and weather authorities and use your own judgment. You assume all risk for activities undertaken in reliance on the Service.
4. Community conditions reports and other content you submit
The Service lets you submit conditions reports, photos, votes, and other content ("User Content"). You retain ownership of your User Content. By submitting it, you grant SnowBrains a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute that content in connection with operating and promoting the Service.
You are responsible for your User Content, and you represent that you have the rights to submit it and that it does not violate any law or third-party rights. You agree not to submit content that is unlawful, misleading, harassing, infringing, or that impersonates SnowBrains or any other person. Reports are moderated before publication, and we may review, decline, edit, or remove any User Content, and remove associated photos, at our discretion.
Copyright complaints. If you believe content on the Service infringes your copyright, email contact@snowbrains.com with a description of the work and where it appears on the Service, and we will review and respond, including removing infringing material where appropriate.
5. Acceptable use
You agree not to misuse the Service. In particular, you will not: (a) attempt to disrupt, overload, or gain unauthorized access to the Service; (b) scrape, harvest, or bulk-download content except as expressly permitted; (c) use the Service to break any law; or (d) impersonate SnowBrains or misrepresent your affiliation with any person or organization.
6. SnowBrains Premium
SnowBrains Premium is a paid subscription that removes ads and may include additional features. Payments are processed by our payment provider, Stripe; we do not store your full card number. By starting a subscription you authorize recurring charges at the then-current price until you cancel.
- Free trial. If a free trial is offered, we will begin charging your payment method when the trial ends unless you cancel before then.
- Renewal. Subscriptions renew automatically for successive terms at the price shown at purchase unless you cancel before the renewal date.
- Cancellation. You can cancel at any time through your account or billing portal. Cancellation stops future charges; access continues until the end of the paid period.
- Price and refunds. We may change subscription prices on a going-forward basis with notice. Except where required by law, payments are non-refundable.
We show you the price, billing frequency, and renewal terms before you purchase, and by subscribing you agree to them. For annual subscriptions, we will send a reminder before each automatic renewal where required by law. You can view or cancel your subscription at any time through the billing portal linked in your account, and cancellation takes effect at the end of the current paid period.
7. Intellectual property
The Service, including its design, text, graphics, and the SnowBrains name and logos, is owned by SnowBrains LLC or its licensors and is protected by law. Third-party data and content remain the property of their respective owners. We grant you a limited, personal, non-transferable license to use the Service for its intended purpose.
8. Third-party services and links
The Service relies on and links to third-party services and websites, including snowbrains.com. We are not responsible for the content, policies, or practices of third parties, and your use of them is governed by their own terms.
9. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any forecast or data will be accurate or complete.
10. Limitation of liability
To the fullest extent permitted by law, SnowBrains LLC and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of or inability to use the Service or reliance on any forecast or content. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or fifty U.S. dollars.
11. Indemnification
You agree to indemnify and hold harmless SnowBrains LLC from any claims, damages, or expenses arising out of your User Content, your use of the Service, or your violation of these Terms.
12. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or misuse the Service. We may also modify, suspend, or discontinue any part of the Service at any time. Provisions that by their nature should survive termination will survive.
13. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above, and material changes will be posted here. Your continued use of the Service after changes take effect means you accept the updated Terms.
14. Governing law
These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws rules, and you agree to the exclusive jurisdiction of the state and federal courts located in Utah for any dispute, except where prohibited by applicable law.
15. General
These Terms, together with our Privacy Policy, are the entire agreement between you and SnowBrains LLC regarding the Service and supersede any prior agreements. If any provision is found unenforceable, the remaining provisions stay in effect. Our failure to enforce any provision is not a waiver of it. You may not assign or transfer these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms do not create any partnership, agency, or third-party beneficiary relationship.
